Terms of Use and Disclaimer – Firmfocus Website and Tools

These Terms of Use and Disclaimer apply to the website www.firmfocus.biz and all other domain extensions operated by Firmfocus. They govern the use of all services offered by Firmfocus to members (subscribers), non-members, individuals, and organizations, regardless of the user's location.

Firmfocus, based in the Netherlands, is the sole provider of its services worldwide. All contracts and legal matters are governed by Dutch law. For users residing within the European Union, Switzerland, or the EEA, the processing of personal data is subject to the General Data Protection Regulation (GDPR).

By accessing or using the website, tools, or services of Firmfocus, users agree to be bound by these Terms of Use and Disclaimer. In the event of any conflict between these terms and specific product terms, the latter shall prevail.

1. Definitions

• Services: All current and future digital or electronic offerings by Firmfocus, whether part of a membership or freely accessible. This includes, but is not limited to, the Firmfocus website (including mobile versions), any digital applications (downloadable or web-based), newsfeeds, archives, and memberships.
• Member: Any individual or legal entity that enters into an agreement with Firmfocus to access the services.
• Visitor: Any person or entity using the services, whether or not they hold a membership.

2. Use of Information and Tools

The information and tools on the Firmfocus website and virtual products are intended solely for general informational purposes and entrepreneurial support. No rights can be derived from their content. While Firmfocus exercises care in curating its services and sources, no guarantees are made regarding accuracy, completeness, or timeliness. Use of the website and tools is at the user's own risk.

3. Third-Party Content and Tools

Firmfocus may include links to third-party websites or provide third-party tools for download. This does not imply endorsement unless explicitly stated. Firmfocus is not responsible for the content, use, or availability of such third-party resources. Users access these resources at their own risk.

4. Intellectual Property

All content and formatting on the Firmfocus website and digital services (including but not limited to text, photos, logos, images, databases, layouts, and domain names) are protected by intellectual property rights. Users and members do not obtain any such rights through access or use.

Without prior written permission, users may not reproduce, distribute, translate, edit, rent, sublicense, or otherwise commercially exploit any part of the content. Automated data collection is explicitly prohibited. Business members may use tools to support their own clients, provided the tools are not shared or made directly accessible to third parties.

5. Investing and Financial Content

Firmfocus is not a licensed investment advisor or broker under Dutch, U.S., or any other jurisdiction’s law. No part of the content constitutes a recommendation, solicitation, or offer to buy or sell financial instruments.

6. Limitation of Liability

Firmfocus aims to ensure that its content is accurate and up to date but accepts no liability for any inaccuracies or omissions unless caused by gross negligence or intent. Use of all services remains entirely at the user's own risk. Firmfocus is not liable for:

7. Technical Use and Fair Conduct

Users are responsible for ensuring their own internet or data connectivity. Firmfocus does not guarantee uninterrupted service. Users must refrain from any misuse that may damage, disable, or impair the services or other users’ experience. Firmfocus reserves the right to modify, suspend, or terminate services and access at any time, especially in the case of misuse.

8. User Content and Stored Data

Users may input and store business-related data using tools provided by Firmfocus, such as the business plan tool. Users retain full ownership of the content they create and store. By using these tools, users grant Firmfocus a limited license to host, store, and process this data solely for the purpose of delivering and improving the service.

Users are solely responsible for the content they submit or store using Firmfocus tools. Firmfocus treats all such information as confidential and will not share it with third parties without explicit permission, unless disclosure is strictly required to comply with binding legal obligations, such as a court order or regulatory mandate.

Upon account termination, users may request deletion of their stored data. Firmfocus will comply with such requests unless retention is strictly required to comply with binding legal obligations or essential operational needs, such as security, fraud prevention, or data integrity. Inactive accounts and associated data will be retained for a period of up to 6 months to allow users the opportunity to renew their membership. After this period, Firmfocus reserves the right to permanently delete all stored data without further notice.

9. Privacy and Data Protection

Firmfocus processes personal data in accordance with the GDPR and its Privacy Statement. Users agree not to share data obtained through the platform with third parties unless explicitly permitted.

10. Pricing and Memberships

Prices for memberships, services, and products are listed on the website and may be changed at any time without notice. Promotional offers may be time-limited and subject to specific terms. Firmfocus does not automatically renew prepaid memberships; renewal must be initiated by the user.

11. Modifications

Firmfocus reserves the right to update or change its services, tools, and these Terms at any time without prior notification. Users are encouraged to periodically review this disclaimer.

12. Governing Law

These Terms are governed exclusively by Dutch law. Any disputes arising from or related to the services will be submitted to the competent court in the Netherlands.
